Who is responsible for your data

Juan Pablo Cruz García (an individual), developer of the Cuídame application, is the controller responsible for the processing of your personal data.

Contact: jpcruzgarcia88@gmail.com

What Cuídame is and what it is NOT

Cuídame is an application for recording medications, vital signs, prescriptions and medical tests, and for sharing that record with other caregivers of the same person.

Cuídame does not diagnose, does not interpret your values and does not give medical advice. It stores what you write down and gives it back to you in an organized way. No figure, chart or alert in the app should be understood as an opinion about your health, nor does it replace a professional.

What data we process

Health data (sensitive personal data): measurements of blood pressure, glucose, temperature, oxygen, weight, heart rate, breathing and pain; medications, doses and schedules; the record of which doses were given and which were not; scanned prescriptions, including the diagnosis and the doctor's name and phone number; and tests ordered. Also the name, the condition and, if you add it, the photo of the person being cared for.

Identification data: your email address and the username you choose, only if you create an account.

Technical data: an identifier of your device so we can send you notifications, and the number of scans you make per month in order to apply the free limit.

Location (optional): if you turn it on while comparing prices, we use your phone's location only at that moment to tell you how far the nearest branch of each pharmacy is. We don't store it, we don't link it to your account and we don't share it with anyone: it travels to the price service, which rounds it to roughly one kilometre before using it, and is then discarded. You can refuse it or withdraw it from your phone's settings, and the app keeps working the same. Location does not change prices: they are the same nationwide.

We do not process your contacts, your calendar or advertising identifiers. We do not use trackers or analytics tools.

The app works without an account

You can install and use Cuídame without registering. In that case all your data lives only on your phone and nothing leaves it.

The account (email address with an access code) is needed only for three things: sharing care with other people, backing up your data in the cloud and taking part in the support groups. All three are optional.

What we use each piece of data for

PurposeWhat it involves
Reminding you about medicationsScheduled alerts on your phone
Sharing careIf you create a care circle, the caregivers you invite see that person's profiles, medications, schedules and measurements, and receive a notice when someone records a dose
Reading prescriptions with artificial intelligenceOnly if you request it and accept it: the photo is sent to Google to extract the medications
Backing up in the cloudOnly if you turn it on: a copy of your data is stored so you can recover it if you change phones
Support groupsOnly if you post: your username and what you write are visible to other users
Sustaining the serviceHow many scans you have made in the month, in order to apply the free limit

Who your data is shared with

We do not sell your data. We do not use it for advertising. We do not transfer it to anyone for commercial purposes.

For the app to work, these providers are involved, and they process the data on our behalf and following our instructions:

These transfers are international. By using the features that require them, you consent to them.

Price search

If you use the price feature, we send the name of the medication you are looking for to our price service (farmapoc) to look it up at pharmacies. We do not send your identity or whose profile it is. The "what is it used for?" information comes from MedlinePlus (U.S. National Library of Medicine) and is for reference only, not a medical instruction; U.S. doses and brands may not apply in Mexico.

This feature applies to Mexico only: the prices and pharmacies correspond only to the Mexican market. It is information for you to review; we do not sell medications and we do not guarantee prices or stock. Always confirm with the pharmacy. See the Terms and Conditions.

About the person being cared for

Cuídame is designed so that someone can record the health of another person: a father, a mother, an older relative.

If you record another person's data, you declare that you have their authorization or that you are their legal representative. It is your responsibility to inform them of this notice and that their data is processed here. If that person asks us, we will honor their rights over their own data even if they are not the one using the application.

Cuídame is not directed at persons under 18 years of age. The support groups require declaring that you are of legal age.

What you post in the support groups is visible

What you write in the groups can be seen by other users, along with your username. Do not post anything there that you would not want others to read. You can withdraw your profile from the community whenever you want without losing the rest of the app.

The app syncs even when closed

When another caregiver in your circle records a medicine, your phone receives a silent system notification and wakes for a few seconds in the background to catch up, even if you don't have the app open. That way it's already up to date when you open it.

This collects no new data and shares it with no one else: it's the same data from your circle, travelling at a different moment. We mention it because it's only fair to know that the app processes health information even when you're not using it.

If you'd rather it didn't, you can turn off «Background App Refresh» for Cuídame in your iPhone settings. The app will still sync every time you open it.

How long we keep the data

For as long as you have the application installed or keep your account. When you delete your account from Settings, your data is erased from our servers, including your cloud backup, immediately and definitively.

If you uninstall the app without deleting the account, the data on your phone disappears, but the data in the cloud remains so that you can recover it. If you do not want it, delete the account before uninstalling.

We keep the monthly scan count, with no clinical content, in order to sustain the service limit.

Anonymous knowledge base

If you authorize it when scanning a prescription (it is a checkbox you can uncheck), we store the diagnosis and the medications with no link whatsoever to you or to the person being cared for: no name, no email address, no account identifier and no exact date. It serves to understand what is prescribed most frequently. It is not possible to relate those records to a person.

Your rights (ARCO)

You may request at any time to:

To cancel, the fastest way is *Settings → Delete my account* inside the app. For everything else, write to jpcruzgarcia88@gmail.com stating your request and the email address you use with the app. We will respond within a maximum of 20 business days, in accordance with the Mexican Federal Law on Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares).

Revoking consent for a specific feature (for example, the cloud backup or the anonymous contribution) is done from the app's settings, without losing the rest.

Security

Communication with our servers is encrypted. Access to your data is restricted to your account and, in the case of a care circle, to the people you have invited. No security measure is infallible; if a breach affecting your data were to occur, we would inform you.

Changes to this notice

If we change this notice we will update the date above and, when the change is relevant, we will let you know inside the application. The version in force is always at the address where you are reading this.

If you consider that your right to data protection has been violated, you may turn to INAI (Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales, Mexico's National Institute for Transparency, Access to Information and Personal Data Protection): www.inai.org.mx.
